Agreement and scope

These Terms of Use (“Terms”) are an agreement between you and Turtle AiP, Inc. (“Turtle AiP,” “we,” “us,” or “our”). The current website does not create an onsite account or take payment. App, connected-device, pilot, caregiver, or support provisions apply when an offered service links to these Terms.

When a covered app, device, account, or pilot presents an acceptance control, you agree by clicking or otherwise affirmatively accepting these Terms. Use of the informational website is also subject to these Terms to the extent permitted by law. You acknowledge our Privacy Policy. If you use the Services for an organization or another person, you represent that you have authority to do so. Additional written terms may apply to a pilot, purchase, provider relationship, or enterprise deployment; those additional terms control if they conflict with these Terms.

Eligibility and authority

If Turtle AiP offers accounts, you must be at least 18 years old and able to enter a binding agreement to create or control one, unless a separate service agreement expressly permits a different model.

If you install a device, provide information, or enable monitoring for another person, you must have that person's informed permission or other lawful authority. You may not use the Services for covert, unlawful, or abusive monitoring. You are responsible for respecting household members, visitors, workers, tenants, and others whose activity could be captured by a device.

What the Services do

Turtle AiP is designed to help families and caregivers stay connected to an aging-in-place household. Depending on availability, a Service may present connected-device activity, generate routine summaries or alerts, support family communication, or help coordinate an in-person or third-party service.

Features may be prototypes, pilots, or limited releases and may differ by location, account, device, or written customer agreement. Descriptions on the website are informational and do not promise that every feature is currently available.

Not an emergency or medical service

Do not use the general Turtle AiP website, software, device, or robot as an emergency-response system or rely on it to detect or respond to an emergency.

If someone may be in immediate danger, call 911 or the appropriate local emergency number. Do not delay professional care while waiting for an app, device, alert, caregiver, or Turtle AiP representative.

Turtle AiP technology does not itself diagnose, treat, cure, or prevent a disease or condition, provide medical advice, or replace a clinician, professional caregiver, or responsible adult's judgment. Any independent licensed provider is responsible for its own clinical services under a separate agreement and notice.

Device, insight, and alert limitations

Connected-device information and automated outputs may be incomplete, delayed, unavailable, or incorrect. Performance can be affected by device placement, household activity, power, batteries, internet connectivity, third-party networks, software versions, linked-user access, and configuration. An alert may be missed, delayed, or false.

You remain responsible for deciding whether and how to respond, maintaining alternative ways to check on a person, and using appropriate emergency or professional services. Do not use an automated output as the sole basis for a medical, safety, housing, employment, insurance, or other significant decision.

Accounts and security

  • Provide accurate, current information and keep it updated.
  • Keep credentials and verification codes confidential.
  • Use a unique password and protect devices that can access the account.
  • Review caregiver access and remove people who should no longer receive information.
  • Promptly notify us at care@turtleaip.com if you suspect unauthorized access or misuse.

Setup, permissions, and updates

Some features may require device installation, internet access, an address or coordinates you select, camera or photo-library access, or notifications. The app or device will explain a permission when it is requested.

You are responsible for following setup instructions, maintaining power and compatible connectivity, installing important updates, and using supported equipment. Do not modify a device in a way that creates a safety or security risk.

Acceptable use

You agree not to:

  • Use the Services unlawfully or violate another person's rights.
  • Monitor, photograph, locate, or share information about someone without permission or lawful authority.
  • Impersonate another person or misrepresent your authority.
  • Access another account, device, system, or data without authorization.
  • Interfere with security, probe for vulnerabilities, introduce malicious code, overload infrastructure, or bypass access controls.
  • Reverse engineer, scrape, copy, resell, or commercially exploit the Services except where law expressly permits it.
  • Use the Services to make an unlawful discriminatory, medical, safety, or other high-impact decision about another person.

Information you provide and feedback

You retain your rights in information and content you provide. You grant Turtle AiP a limited right to host, process, transmit, and display it only as needed to provide, secure, and support the Services and as described in the Privacy Policy. You represent that you have the rights and permissions needed to provide it.

If you voluntarily send product ideas or feedback, we may use them without restriction or payment, but we will not treat feedback as permission to use personal or consumer health data for an unrelated purpose.

Turtle AiP materials and license

Turtle AiP and its licensors own the Services, software, designs, branding, and other materials they provide. Subject to these Terms, Turtle AiP grants you a limited, personal, non-exclusive, non-transferable, revocable license to use available Services for their intended household or organizational purpose. No other rights are granted.

Third-party services

The Services may rely on or link to third-party devices, app stores, identity providers, maps, communications tools, cloud systems, videos, or professional services. Their terms and privacy policies govern their products. Turtle AiP does not control third-party services and is not responsible for their independent acts, availability, or content. Platform terms from Apple or Google may also apply when you obtain an app through their stores.

Fees and purchases

If Turtle AiP offers a paid product or service, the applicable price, billing schedule, cancellation terms, taxes, and refund terms will be shown before you agree to purchase or in a separate written order. The current informational website does not itself collect payment-card information. We will not charge a payment method without authorization.

Privacy

Our Privacy Policy explains how we handle personal information. Our separate Consumer Health Data Privacy Policy describes additional practices and rights for covered consumer health data. Agreeing to these Terms is not consent to a health-data practice when law requires separate affirmative consent.

Availability, changes, and suspension

We may maintain, update, add, remove, suspend, or discontinue a Service. When reasonably possible, we will provide notice of a change that materially reduces a paid feature or access to stored information. Maintenance, emergencies, security incidents, and third-party outages may require action without advance notice.

We may restrict or suspend access when reasonably necessary to protect people, data, devices, or the Services; address suspected misuse; comply with law; or enforce these Terms. You may stop using the Services at any time and may request account or data deletion through our data request instructions.

Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available.” Turtle AiP disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation; compatibility with every device or network; or that any sensor, pattern, alert, provider, or third-party service will be accurate, timely, available, or suitable for your needs. These disclaimers do not limit rights or warranties that cannot lawfully be excluded.

Limits of liability

To the extent permitted by law, Turtle AiP and its officers, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption arising from the Services.

Nothing in these Terms excludes liability or consumer rights that cannot be excluded under applicable law.

Governing law and disputes

These Terms are governed by Washington law, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to these Terms or the Services will be brought in the state or federal courts located in King County, Washington, and the parties consent to those courts' jurisdiction. Nothing here prevents either party from seeking appropriate injunctive relief or using a small-claims process when eligible.

General terms

If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remainder will continue. A delay in enforcement is not a waiver. You may not assign these Terms without our written consent; Turtle AiP may assign them in connection with a reorganization or business transfer. The headings are for convenience. These Terms and any applicable written order or additional terms are the entire agreement about the covered Services.

Changes to these Terms

We may update these Terms as the Services or law changes. We will update the date above and give conspicuous notice of material changes. When appropriate, we will ask users to affirmatively accept material changes before they apply; continued use alone will not substitute for separate consent where law requires it. The updated Terms will apply prospectively from their stated effective date.
